This document is written to be readable. Section headings help you find a topic, but every section forms part of the policy.
1. Agreement to these terms
These Terms of Service govern access to eMaaree’s websites, applications, point-of-sale tools, APIs, and related services. By creating an account, accepting an invitation, or using eMaaree, you agree to these terms on behalf of yourself and, where applicable, your business.
If you use eMaaree for an organization, you confirm that you have authority to bind that organization. If you do not agree, do not use the service.
2. Accounts and authorized users
You must provide accurate information, keep it current, and safeguard credentials and verification methods. Workspace owners control invitations, roles, permissions, branches, and access to business records.
You are responsible for activity performed through your accounts unless caused by eMaaree’s breach. Notify us promptly of suspected unauthorized access or compromised credentials.
3. Subscriptions and billing
Paid plans are billed in advance on a monthly or annual basis as selected. Prices, included usage, taxes, and renewal terms are shown at checkout or in an applicable order form. Except where law requires otherwise, charges already paid are non-refundable.
Subscriptions renew automatically until cancelled. You may cancel before the next renewal date, and access to paid features will continue through the current billing period. We will provide reasonable notice before materially changing plan prices.
4. Acceptable use
You may use eMaaree only for lawful business purposes. You must not:
- Access another workspace or account without authorization.
- Bypass security, usage limits, approvals, or access controls.
- Upload malicious code or interfere with the service or other users.
- Use eMaaree to violate privacy, employment, tax, financial, consumer, or other applicable laws.
- Reverse engineer or copy protected parts of the service except where law expressly permits it.
- Resell or provide the service to third parties unless your plan or written agreement permits it.
5. Your business responsibilities
eMaaree provides operational software, not legal, tax, accounting, employment, or financial advice. Your business remains responsible for product information, prices, taxes, receipts, payroll rules, inventory decisions, regulatory registrations, record retention, and transactions with customers and suppliers.
You are responsible for reviewing generated reports and documents before relying on or submitting them to another party or authority.
6. Business data
You retain ownership of information submitted to your workspace. You grant eMaaree the limited rights needed to host, process, transmit, back up, and display that information to provide and improve the service.
You confirm that you have the necessary rights and lawful basis to enter and process customer, supplier, employee, and other personal information. Our handling of personal information is described in the Privacy Policy.
7. Payments and third-party services
Payment providers, mobile-money operators, banks, messaging platforms, hardware, and other integrations are operated by third parties under their own terms. eMaaree is not responsible for their availability, fees, settlement decisions, or independent acts.
You authorize eMaaree to exchange the information reasonably necessary to operate integrations you enable.
8. Availability, updates, and offline use
We work to keep eMaaree reliable but do not promise uninterrupted or error-free operation. Maintenance, internet outages, device limitations, and third-party failures may affect availability.
Offline features are designed to preserve supported workflows temporarily. You must reconnect and resolve synchronization conflicts promptly. Offline records are not fully protected until successfully synchronized and backed up.
9. Intellectual property
eMaaree and its licensors own the service, software, designs, documentation, trademarks, and related intellectual property. Subject to these terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to use the service for your internal business operations.
Feedback may be used to improve eMaaree without restriction or payment, provided we do not identify you publicly without permission.
10. Suspension and termination
We may restrict or suspend access where reasonably necessary to address security risks, unlawful use, non-payment, material breach, or harm to eMaaree or others. Where practical, we will provide notice and an opportunity to resolve the issue.
When the agreement ends, your right to use the service stops. Workspace owners should export required records before access ends. Provisions that by their nature should survive termination will remain effective.
11. Disclaimers
To the extent permitted by law, eMaaree is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. Nothing in these terms excludes rights that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. eMaaree’s aggregate liability relating to the service will not exceed the fees paid for the affected service during the twelve months before the event giving rise to the claim.
These limitations do not apply where liability cannot legally be limited or excluded.
13. Contracting entity and governing law
The applicable eMaaree contracting entity, governing law, and dispute forum may be specified in your order form or subscription confirmation. If your agreement does not identify them, contact us before purchasing a paid plan so the terms applicable to your location can be confirmed.
14. Changes and contact
We may update these terms to reflect product, legal, or operational changes. We will post the revised terms, update the date above, and provide additional notice for material changes. Continuing to use eMaaree after the effective date means you accept the revised terms.
